FETO SUR assisted the mother of deceased seafarer to get death compensation

The Far Eastern Territorial Organization of the Seafarers’ Union of Russia assisted the mother of a seafarer to get compensation for her son's death. Nikolay Sukhanov, FETO SUR Chairman, reported it on November, 21. In October 2021, the man was employed as a Third Engineer of a freezer trawler “Vector” by the Yuzhno-Sakhalinsk-based company “Moneron” LLC.

It is known that on February 8, 2022, the ship was fishing for crab in the Tatar Strait. The seafarer was resting before the watch, which he was supposed to start at four o'clock in the morning. Half an hour before, his colleague looked into the cabin to wake him up, but did not find the seafarer inside. A “man overboard” alert was sounded, and the crew took measures to search for the Third Engineer in the offshore area. All attempts made to find the man were unsuccessful. The accident investigation commission did not identify those responsible for the incident - by decision of the Nakhodka City Court on October 18, 2022, the Third Engineer was declared dead.

In mid-November of this year, Vasily Savelyev, a FETO SUR lawyer representing the mother of the deceased, made a statement at one of the court hearings on that case. According to Article 1079 of the Civil Code of the Russian Federation, legal entities and citizens whose activities are associated with an increased danger to others are obliged to compensate for harm caused by a source of increased danger, unless they prove that harm appeared as a result of force majeure or intent of the victim. According to the lawyer, crab fishing in the open sea at low temperatures was an activity that creates an increased probability of harm due to the inability of its full control on the part of a man. The victim's representative stated that the mother of the deceased suffered moral harm because she was taking the loss of her son hard. Finally, the court ruled to recover compensation for moral damages in the amount of one million roubles from the shipowner. The seafarer's mother thanked SUR for legal assistance.

Previously, she received payments for the death of her son, due by law, from the Social Insurance Fund of the Russian Federation.
